RIGHTS OF PASSENGERS, USERS-TOURISTS AND RESIDENTS OF TRIPS

The contracting and cancellation policies are included in the content of each one of the Habita Trips Adhesion Contracts, which are elaborated in accordance with the current legislation in commercial and mercantile matters, those that promote and protect the rights and culture of consumers, as well as the regulations indicated by the official Mexican norms in tourism matters, in order to offer equity, certainty and legal security to our clients.

The Contract of Adhesion is part of the travel documents and are offered and shown prior to the contracting of the services that Habita Trips operates as an intermediary.

The payment of advances or settlement of the amount of the services by the client or user-tourist, as well as the use of the contract itself, coupons, tickets, vouchers, or any other document issued in his favor for the same, implies his total acceptance of the Contract of Adhesion, as well as the general contracting conditions contained therein.

The conditions under which each of our destinations operate may vary among them, which gives rise to specific contracting and cancellation policies for each one of them. In the quotation of services offered to our clients, the contract of adhesion that regulates the contracting, development of the services and in its case the cancellation of the contracted services is displayed in its entirety.

The contracts that govern the contractual relationship with the users-tourists, as well as with the retail travel agencies in their capacity as intermediaries, are of a public nature and can be consulted, according to the conditions and characteristics of each of the travel packages and/or services contracted, on our web page http://habitatrips.com/ in the Passengers' Rights section as well as in each of the descriptions of our travel packages and/or services offered on the same web page.

In the specific case of air services not integrated into a travel package, where the passenger air transportation service does not form part of the integrated travel package services, the users-tourists are subject to the passenger rights set forth in the Civil Aeronautics Law, from which the following may be inferred:

Prices and Rates.

You must be informed and respect the fares as well as their restrictions, and the cost of the ticket must include all items including taxes (art. 42 Bis of the LAC).

Information and Advertising.

It must be accurate, truthful, verifiable and clear and must not mislead or confuse (art. 42 Bis sections I and 11 of the LAC).

Disability.

Persons with disabilities have the right to transport instruments inherent to their condition without additional charge (art. 47 Bis section I and 47 Bis 1 of the LAC).

Itinerary changes.

Any change must be informed to the passenger through telephone calls, text messages, e-mails at least 24 hours prior to the scheduled departure and if the change occurs within these, it must be made immediately (art. 47 Bis section III of the LAC).

Delay, delay and cancellation.

In case of flight delays or cancellations attributable to the airlines, they must compensate passengers (art. 47 Bis sections V and VI of the LAC).

Landing at a different location.

In case of landing at a different place, the passenger must be transferred by the fastest means of transportation available (art. 47, section VII of the LAC).

Baggage ticket.

The airline will provide a baggage registration ticket for each checked bag, one for each bag and one for the airline's control (art. 47 Bis section IX of the LAC).

Information and payment of indemnities.

Know the terms and conditions of the service, compensation policies and rights; Within 10 calendar days following the claim, except for food and lodging. Forgiveness is not applicable in the case of airline liabilities; Preferential rate when traveling without baggage (art. 47 Bis section X of the LAC).

Attention modules.

Airlines shall have a customer service module in all terminals where they operate (art. 47 Bis 2 of the LAC).

Pets.

They may be transported and measures must be observed to reduce stress, suffering, pain and trauma during their mobilization (art. 50 of the LAC).

Oversold.

Overbooking, airlines must compensate passengers and ask for volunteers to waive boarding, with preference being given to boarding disabled persons, senior citizens, unaccompanied minors and pregnant women (arts. 52 and 52 Bis of the LAC).

Luggage.

Compensation for destruction or damage of carry-on baggage of $6,448.00 pesos (80 UMA's), and for loss or damage of checked baggage of $12,090.00 (150 UMA's) (art. 62 of the LAC). Daily value of the UMA=$80.60 pesos DOF 10-01-2018.

If you are flying domestically, you also have the following rights:

Infant under 2 years of age.

An adult may transport him/her without paying an additional fare, including a stroller, but without the right to a seat and free baggage allowance, by issuing the respective ticket and boarding pass (art. 47 Bis section 11 of the LAC).

Connection.

On connecting or round-trip flights, you may use any particular segment, and you may not be denied boarding if you have not boarded on any of these segments (art. 47 Bis section IV of the LAC).

Refund of the cost of the ticket.

It may be requested if made within 24 hours of purchase at no charge (art. 47 Bis trace. VIII of the LAC).

Luggage.

Carry at least 25 kilograms of checked baggage free of charge, and two pieces of carry-on baggage that together do not exceed 10 kilograms and whose dimensions are not greater than 55 cms. long, 40 cms. wide and 25 high (art. 47 Bis section IX of the LAC).

In any case, user-tourists are subject to the contracting, reservation and cancellation conditions indicated by the final service providers, both in national and international destinations. Demand at all times the delivery of the adhesion contract.
